A federal judge has tossed a lawsuit brought against the Nuclear Energy Institute by a former member who said the association had unfairly locked it out of a database used to screen workers at nuclear power plants.
NextEra Energy sued NEI in February for denying the company access to the association's Personal Access Data System, which is used to determine whether nuclear power plant employees constitute security risks. The company announced in January it was leaving NEI because of policy disagreements with the association.
In its lawsuit, NextEra argued NEI was taking punitive action against the company for leaving the group. The company also said the association's offer to allow it to maintain access to the database for a $860,000 fee was unreasonable.
U.S. District Judge Donald Middlebrooks dismissed the lawsuit in a Sept. 25 ruling, noting the agreement that NextEra signed to use the database clearly stated it was for NEI members. The association's refusal to allow NextEra access "was not a breach of any provision of the agreement," he said.
Neither NEI nor NextEra had commented on the decision as of Thursday morning.
